If it was zero it would still be appealed. LOL The RR point of error will be a point of error raised on appeal. Even if he strikes the middle ground, it's still going to go up with that point of error included. I think his best chance of reversal on the RR% would be if he were to only order a 3.5% RR for the ongoing, wilfull, infringement. Time will tell.
