I think it's ok. He's just stating the obvious...current terms state that they don't get to "keep" any earnings on the books, thus "fundamentals" (look, no capital!) look like crap. But the political overview is key as to any change in those terms...so not really news, and an obstacle already recognized/factored into the price.
