motion for summary judgements are almost always filed......doesnt mean someone has an airtight case thats for sure as they are denied very easily.........there have been multiple summary judgements filed in this case and rebuttals......your information is not correct

the plaintiff usually if not always is the first to file a motion for summary judgement and the defendant would then file on in response........that is very normal and has already happened a couple times.......these filings are all accessable through the clerk but must be sent for and are nit easily abtainable like most modern courts that file electronically on pacer

Being in this situation, what would you do? It sounds like our best option is to merge with Virgin, end litigation, and drill.

Where's that kind of funding coming from? What about the loan for $8.5 mil we have a commitment letter on?

Meanwhile Volk takes his time on a PR, possibly for legal reasons, while the shares get traded into strong hands of his friends quietly. Maybe it's a coincidence a nice bottom has formed and we have gone from heavy dilution to very little.

Just a theory and my opinion.
