smd1234, I'll show you how to dial into the applications.
5,513,327 March 31, 1994 Rambus cited the Grover 5,361,277 patent as prior art that’s 7 months before the USPTO issued the November 1, 1994 application to Grover. So it is possible.
"A member of the public cannot obtain direct physical access to any pending published (original) application, but may obtain a copy of the papers in the application file as follows:" That's straight off the web site. http://www.uspto.gov/web/patents/access.html
In the early 90's I’m sure you paid for these services. Here’s another search tool for Patent Applications. http://appft1.uspto.gov/netahtml/PTO/search-bool.html Just use the search term IN/Farmwald I’m sure you and I “Joe Public” are limited but you can augment this with other paid services and work directly with a USPTO representative.
My point here is when the Grover prior art was listed it should have put Grover on notice with that application filing.
Now concerning Rambus's 5,243,703 if Rambus could find the 5,513,327 while in application phase Grover should have been able to do the same.
I agree with jeffreyscott this is just a nuisance suit. The more I learn the better I feel.
