Housekeeping. T-Mobile had several requests for relief - I don't remember off hand what they were - maybe patent invalidation, etc. (order of non-infringement was the principle request) but all claims need to be resolved for entry of final judgment, and as a prerequisite to an appeal, if any.
The Markman appeal to the Federal Court cannot move forward until a Final Judgment is issued in the lower court---we are almost there as a Summary Judgment finding non-infringement has been adopted...
TMob also sought a SJ for invalidity---that item remains unresolved at this point...it will be handled either by stipulation by the parties or a SJ by the court---at that point, the Final will be issued and the markman appeal can be sought if desired...
