It seems that they are trying to stop E15 only, right? Although it will be a hit for the ethanol industry in the long run, I don't think it will heart the ethanol gallons sold so much in short term, because E15 is not very popular as of now. I just hope that the ruling will not be made until PEIX Q1 earnings call :D

If, on the other hand, government decides to increase tax on oil/gas (and not on biofuels), as this nytimes article explains, the demand for higher ethanol blends will for sure increase multifold.

The opinion of the Circuit Court I would have to read. However, we see the fear big oil has and the profit in ethanol right now. I will look up the case and see what it says. Lets hope the Supreme Court refuses to hear.
