Whyte's enforcability decision will stand as far as the NDCA is concerned - I agree

My concern is the need to have CAFC resolve the discrepancy btwn what Whyte decides and what Payne decides, and the delay resulting from that.

Do you agree?

He still gets his trial but it has NO EFFECT on the enforceability of the Patents in the Hynix case.

So does the FTC just ignore Whyte's ruling

The FTC is ignoring Mcguires ruling. I don't see why they wouldnt just pick and choose the bad stuff. lol.

I don't know how all this will work out. I'm cautiously optimistic. Payne can still do bad things IMO. I do think we see a Whyte ruling before Payne can stick his ugly neck out though.
