#15285 RE: JohnG #15271

NOK's past ploys have cost QCOM sh's $Billions!

Qualcomm had CDMA2000 all set for migration from GSM.

Nokia et al severely damaged Qualcomm's profits over the recent years by causing delay in migration to 3G (through the conception and subsequent attempt to insert its own IPRs in "W"cdma).

It would be utterly insulting if, in addition to the damages already suffered by Qualcomm, Qualcomm would be forced to put a price on Nokia's use of Q's IPR's in order to help Nokia migrate users from GSM to 3G. IF QUALCOMM IS FORCED TO OFFER TO LICENSE THIS IPR TO NOKIA, IT SHOULD BE FOR A PRICE SUCH THAT QUALCOMM ENDS UP OWNING NOKIA. Anything short of this would be a miscarriage of justice!

ABOVE REFERS TO ----> >>>> I don't believe that US patent law requires you to license your patents to a particular party that demands you do so. It may not require QCOM to license its patents to GSM phone maker NOK. Why should QCOM do this. Perhaps QCOM just doesn't want to set the precident of placing a value on one or two of its patents. Why be cherry picked or ever go down that road. The answer is that they don't want to do this and they don't appreciate NOK's effort to change the deal when its current agreement expires in 2007. <<<<
