I watched Fitz' entire 1.5hr press conference, and yes the baseball analogy was great - did the pitcher intentionally hit the batter in the head with the baseball, or was he aiming for the batter's shoulder, or did he simply slip off the mound. Sometimes it's hard for the ump to prove.
When you lie to a prosecutor and he has the evidence, that's a very different story.

Fitz is very professional and was careful with his answers to reporters questions - more than once he reminded everyone listening that Libby is innocent until proven guilty.
Fitz did say he would prosecute the case...Libby better get a very good criminal att'y.
