Very nicely argued. However, what is the chance the judge will admit he did a poor job in the first place (after three months) and grant Calypso's motion?

Actually - seems well argued to me,... IF the plain term language was used in the patent - and the patent was approved with that language,....

Would seem to me that the language intended and approved in the patent would be what should be used in defining the terms.

Now,...will the arguements have any effect on Judge Payne's earlier construction? That remains to be seen.

IT IS THEREFORE ORDERED that the Claim Construction Memorandum and Order
issued by Magistrate Judge Payne is VACATED. The Court will issue a new Order addressing
each of the terms in dispute.
