I recall that BNYM stated the guarantee was in fact a guarantee for payment, IF, and only IF there was money in the trust...

yes they are responsible -what is puzzling is lehmans tried to put us in the trust to start with - now it may be where we "think" we need to be and I have to believe the entire class is to be treated the same -if not WOA!!!!!


Is the BNYM on the hook for this error? Not filing our class 10b preferred securities claim under their guarantee?
