I'd be very surprised if the Judge took it upon himself to issue any summary judgements due to the magnitude of this case. I would suspect he'll leave it up to a jury so the spotlight of an appeal by either party would not rest directly upon such unilateral actions on his behalf.
Still contend TMobile knows its in none hell of quandary. They know full well whether or not they are guilty. Do they let it go to trial and be found guilty then try to negotiate a licensing agreement with a hostile party or seek a settlement now and try to resolve all issues at one time, then be in ownership of the patent to go after the industry for licensing fees ?
