No, the divers haven't sued the wrong company, please review for yourselves the letter of indemnification from MEXP that Raider21 referred to. Amongst the unpaid divers and all other plaintiffs having claims against MEXP, this letter clearly states that they willingly bear full liability as the funding partner.
Raider: Did you see the filing which stated MEXP claimed to have $799,289 in cash & cash equivalents (usually their claims include very little cash, and mostly "equivalents" lol). Of course they also PR'd the supposed $3.2mm order as well. It might be something for you to have your attorney investigate. If they have anything, it may be something to go after. If not, it'll just be another nail in the MEXP coffin.
