A MM won't sponsor a company still under SEC investigation. The SEC makes a MM responsible for any previously suspended Greysheet stock it wishes to submit a 211 for. If a MM starts to provide quotes for a company whose financials are not still accurate, they themselves will be in trouble.

“Rule 15C211 Under SEC Rule 15C211, a U.S. securities broker or dealer may not publish a quotation for any security unless certain information concerning the issuer is available and the broker or dealer has a reasonable basis for believing that the information is accurate.



It's quite likely during the SEC investigation a Form 10 filing will be forced. Management's way of demonstrating to the SEC they are cooperating. Without a Form 10, with audited financials, a 10Q, and a 10K, no MM is going to touch the stock.

In another words the MM CYAs themselves heavily. It takes a lot of effort on their part. Yet another reason not too many Greys ever make it back. Now go back and read the CEO's Email.
