The timing was coincidental. People had been bringing up the delinquent filings on and off for at least a year and a half. Maybe some wrote to the SEC. Maybe they didn't. In any case, my own guess is that this investigation has been going on for months, at least. The SEC does not suspend from one day to the next.
What happened was entirely Fallacaro's fault. If he wanted to avoid trouble, he should have played by the rules. He failed to do so.
