OK, sometimes a company will sign a licensing agreement and the contract will state that the license cannot be transferred to another party.

XYZ agrees to license the ability to buy/sell/make pdt from company ABC. This agreement cannot be transferred to another entity, it's exclusive.

In the case of APDN, we dont know if the mandate issued from the D.O.D that requires all companies to use SigNature on their chips, is exclusive to ONLY APDN..or could a 3M (hypothetical) buy APDN an incorporate it.

This isnt a licensing agreement but it is exclusive to APDN.

Would an entity that buys APDN have to go through re-certification?
