"It does not say on website that the AMS (African Mining Services) dump trucks are being used. They don't look like they are using them to me, on their property." __________________________________________________________________
They have been using the AMS Company name without 'Permission or the Rights of the company'... It needs to be removed...!
On the bottom of the photo it clearly states EkomEya1... A photo of AMS trucks with Brookes...!!!
A 'CEO', the 'Company', is responsible for 'Accuracy and Legal Disclosures' on their website.
They should remove or update all web content as it becomes inaccurate or misleading, and prominently date all disclosure items so the reader can see how current they are.
And it would be wise if they didn't post material information on their website that hasn't been already been disclosed through SEC filings or press releases.
Internet venues with regard to company matters run many risks including selective disclosures. Further, statements made under these circumstances are informal, and therefore possibly incomplete or misleading.
Statements made by executives in these venues can be attributed to the company.
In most states, you can be sued for using someone else's name, likeness, or other personal attributes without permission for an exploitative purpose.
Usually, people run into trouble in this area when they use someone's name or photograph in a commercial setting, such as in advertising or other promotional activities. But, some states also prohibit use of another person's identity for the user's own personal benefit, whether or not the purpose is strictly commercial.
There are two distinct legal claims that potentially apply to these kinds of unauthorized uses: (1) invasion of privacy through misappropriation of name or likeness ("misappropriation"); and (2) violation of the right of publicity. (The "right of publicity" is the right of a person to control and make money from the commercial use of his or her identity.)
Exploitative Purposes and a misappropriation and/or Right of Publicity...!!!
To reiterate... For exploitative purposes... The company website was carefully designed, nicely marketed, but very misleading information...!!!
AMS was NOT pleased... Cc'd to their Legal Department...

Dear xxxxx,
I can confirm the company you refer to are not using the services of AMS.
We have no commercial dealings whatsoever with Kat Exploration and/or Kat Gold Holdings Corporation.
Why they have a picture of our equipment on their web site is something I do not have an answer for.
