Tmob's attorneys might want to read pages 7&8 of the settlement agreement with Daic concerning his standing. Calypso pursuant to the agreement gave daic an interest in the claims against Tmob and allows him to pursue the case against Tmob in the event calypso doesn't. So I'm calling the latest Tmob filing smoke and mirrors. Let's get this thing to the Markman. I don't care if they request delays on everything and make them due prior to the 10 sep date. Mr. Judge don't let them move the Markman hearing date, they've wasted enough of our time already, get 'er done.
I guess Tmob wasn't expecting such a technical claim construction brief and they need someone to interpret it for them. Why else would they need an additional week?
