I don't see any wiggle room in the complaint either. The SEC has the dates and the numbers. And Monk's own words.

The disgorgement and penalties--which could amount to more than $2.4 million--will go to the SEC. They'll subtract their own costs and then--MAYBE--distribute what's left to shareholders.
