This may not make much a difference anyway as courts may combine very similar cases for their convenience and to manage their resources. Also as a negative when defendants are combined it allows them to act to combine their resources.

If it's old news, and does not apply to eDigital as Neverending suggested, then why do you say that you doubt DM will continue due to the additional cost of individual discovery?
