There is no tax benefit (gain or loss) until you sell and absolutely no tax benefit to a reverse split. Gerry has full contol of what happens here and the timing of same. He can bury anyone who is short. Anyone who owns shares but is unwilling to wait for a good outcome should probably sell. This will happen when management wants it to happen and they have lots of options available to them. It is costing those who are short money each day this goes on without resolution and so those short are going to be very frustrated. What I would do is take the company private and when the company is profitable do an IPO on a higher exchange but that is just me. Management may be looking to buy back the cheap shares of any frustrated sellers or shorters willing to sell counterfeits. What if the company starts paying cash dividends to shareholders who are not employess of the company. How about a dividend of restriced shares in certificate form to shareholders? I could go on but you get the point.
Go TEVE!!!
