call it what you may, but they can't have a split or a dividend until shares are accounted for. Now, maybe many already settled up. There, is that a better term for you. Settled up...Works for me. Maybe you and I can't exactly borrow shares very easily, but I know for a fact that Skykes recommends an off shore account that any human being can open who will gladly get you shares to short on penny stock if at all possible. But, he has stated that there are times they just aren't any available.
Go check it out. And many times the MM's themselves are short. They sell you stock and hope to heck they can conjure up some to cover it. So, that is a lot about those short positions. But, like any other not so reputable people, sometimes they don't bother to worry about it if it looks ok for now and then BAM! It isn't ok. And yes, it does happen sometimes.
And I know of two shorting groups, both large that are out there that can short...
