Icm offers the whole immunity deal which is a reason the cheaper system may be being used by producers. Officially in court this will not hold up and those producers would have to pay up. If Icm has contracts to state immunity to the producers and they in turn think they are immune to litigation with that, that may be the reason for it. Maybe the producers think conversion from icm to Gers would be a better solution in the long run if litigation goes well for Gers.
