Four representatives from the EPA spent most of Friday with Storey and Lyon county residents to hear concerns, discuss actions and review the potential environmental impacts of open pit mining in the Carson River Mercury Superfund Site. The group toured the superfund area including Gold Canyon, American Flat, Six Mile Canyon and Sutro.

Discussions included the legal action the EPA has taken against CMI under section 104e of CERCLA (Comprehensive Environmental Response, Compensation and Liability Act). As a part of the clean up of a Superfund site, EPA must investigate to find all of the potentially responsible parties to determine liability.


During the last 10 years, Comstock Mining and Plum Mining has disturbed and relocated potentially toxic materials (mercury, arsenic, lead, cyanide). Residents requested that a 104e inquiry be initiated. While Comstock has yet to fully comply with the submission of all the information legally required, it is expected that the information will be forth coming.

The EPA discovered a number of issues of concern during their meeting.

1. Current testing by CMI is not sufficient to locate all remaining toxic materials. EPA will conduct additional testing.

2. Possible need for air testing. Disturbed soils and high winds can put these toxic materials into the air. The current permits issued by Storey County and NDEP do not consider this and the EPA will determine if further testing and monitoring during open pit mining is required.

3. Location of milling activities in the headwater basin of American Creek which drains into the Carson River. Several years ago there was an environmental event in which cyanide laced water spilled over the containment area. This could pose an environmental and health risk in the future.
