I think they had a plan, for sure! As far as required to be silent, not so sure. BD had a chance to pick up Atrinsic cheap but they were not ready for 40 million shares to be bought by others. They wanted them all, they played the game and lost. The dark period is time to regroup to see what can be salvaged from the original deal.
