#24813 RE: learning curve #24811

Here's NSF's response:

Your inquiry about MusclePharm’s comments regarding the NSF Certified for Sport program came to my attention as the Business Unit Manager of the Dietary Supplements program here at NSF International. I would like to discuss the topic further with you, and it will probably be easiest by phone, so we can easily have an open discussion covering the program details and the acceptable use of the NSF Marks.

Is there a number at which I may call you this afternoon? Or please feel free to give me a call at your convenience as well. My contact information is below my signature.

In general, I can tell you that we have already begun an investigation into how MusclePharm is using the NSF Mark and certain statements on their website and labels, so thank you for your concern and for letting us know. As the NSF Dietary Supplements programs are fairly new, we are also still in active process of educating our customers and the end consumers more on the use of the NSF Marks and their meaning. If we see misuse of the Mark or statements on a company’s website, we review them and request the company revise the site, if that is the action we deem necessary. If product Marking (with the NSF Mark on product labels) is incorrect, we do not insist the customer pulls the mismarked product from the shelves, but we do request that future lots produced have the Mark removed, OR the company may determine to indeed have that product Certified.

I hope these general details help, but I would be more than happy to discuss this further as well.

Best regards,
