I believe I have heard of amounts for damages being appealled. However, with MC and V making record profits this past quarter, and this being a "David and Goliath" type of situation, I doubt it will go to trial. There certainly will be talks of an out of court settlement between the parties. Whether or not there is agreement is another issue. If there is an appeal I believe it goes to a judge and not another jury.
