It is hard to see how HP can fashion a tort claim with Oracle. Failing to provide software support for someones product is not a tort. A better path to achieve significant damages would be for HP to try to find an antitrust claim with treble damages against. Oracle but is hard to construct an antitrust theory that will hold water.

The best legal strategy is to file a contract claim to force Oracle to continue delivering Itanium database software. The relief that HP needs is the ability to continue selling Itanium systems. And for that, HP needs an enterprise strength database like Oracle.
