That's the problem. In that case, the SEC would still do nothing. CMEY would still have to get an MM to file a Form 211.
A few companies have persuaded the SEC to give them a letter saying they've closed their investigation and have no intention of taking action. But that's very rare. Usually they don't suspend without having good reason to do so.
