All that shows is they don't have any shortfall agreement on the DVD distribution (which is what that entire quoted section is about). It doesn't say anything about the theatrical shortfall, which is what was/is in question. TBH, I'm not sure why it's still "in question" as it's already been clearly stated here multiple times that EP confirmed there was one.
I see a ton of positives within what you posted, other than non-assistance from MGM, but I dont think the full clarification was given there and was being stated there for the DVD/Blu-ray distribution, not theatrical. Thanks for posting
