That article is SO true. I'm a licensed realtor and it is VERY important, especially when you are selling proprty in rural areas to explain the deed to the prospective buyer completely. The problem is, most realtors don't address it, like the article says. They are only interested in making the sale and getting a commission.

Any deal is negotiable and if these prospective buyers knew about the mineral rights they could either try and negotiate to include the mineral rights in the purchase, or just simply not buy it.

In many cases if there is not already drilling activity in the area you can get the mineral rights incorporated in to your deed just by submiitting some simple addendums and perhaps paying a little extra. You can also include the air space above the home to a certain level in the deed.

There are just too many unethical realtors out there that don't explain these things. The buyers do have rights, and they could go after the brokers of these agents but most just want to sell and get the hell out of there before the value of their home goes down even more.
