Well, they haven't always had pristine legal counsel (e.g., the ratchet provision mishap leading to the Alpha gang settlement) and I think they probably try to do most of their filings on the cheap. Not surprising. I'd rather they spend their money on exploration activities then counsel at this stage (though it sure would have been nice to avoid that settlement!)
I think the re-filing here was a change made for stylistic reasons/appearances. An equity line in the OTC world has a certain negative connotation whereas a "financing agreement" sounds more legit.
