The question is did JMW know about Arts conflict; was it disclosed?
It is a bit confusing to me because it contains lawyer fees in the Stip and an issue of conflict that would affect proper representation of the Class throughout the last year.
Can anyone clear that up?

I did find out by e-mail with Ben that he will be attending the Hearing either in person or telephonically.



Under the 2003 WARRANT AGREEMENT written consent is required of the LTW Holders on any Action that will adversely affect the Holders.


Certainly this Agreement and Stipulation as well as a cancellation of the LTWs on the Effective Date before a Trigger event is such an adverse affect.
