If I understand what your saying correctly, I don't think it was a smart move on the defendants part. While the defense may think of themselves as cunning it seems to me they don't know much about pr. If I where the judge it would be difficult at the point of the comment on to make an unbiased ruling. I would feel as though the defendant was trying to mock me.
