Rawnoc- IMO, the insurance companies are going to hate this bill. (which is one of the main reasons I don't think we will be lucky enough for this to pass).
If I read this correctly, then each time there is a fender bender the "victim" knows he can go to the ER and have the Insurance Company pay his 10k bill. Many of these cases will be thrown out, but that doesn't help the IC. In the current environment, it is likely the junk case would just have settled for maybe $5,000 which is cheaper then the for sure $10k they will have to pay the ER.
We can only hope.
