yes the 30% could get smaller, I agree, but preferred being more senior would not matter here as the DIMEQ possible majority math comes out of the Common cut, not preferred cut..keeping intact there seniority 70% cut -the 70/30 split...Wouldn't this be ironic if DIMEQ works out that way whereas the commons actually lose out because of TFjmw ruling on DIMEQ and the genius of EC deal? IMO This DIMEQ ruling also throws into question the majority ownership and NOL issue brought up by McDerths DD into IRS rules
