Of course we want to see something filed on Jan 9th---but there are other options available on Jan 9th...

the company must file something---either the settlement-or a motion to be retained on the docket to continue the case...else the case will be dismissed under rule 165A Texas law----a dismissal without prejudice leaving open a retry...
