Being quite honest with you I'm not all that knowledgeable on exactly how the Government determines when it will seek restitution in situations such as this. Either way should victim restitution ever come into play from ANY Judicial action I'm sure you'll become aware of it through one means or another.
In the Tulsa Cartel sentencing ( criminal trial ) the Court specified in its decision that those convicted would have a portion of their ill gotten gains placed in a victims restitution fund. This is usually sought by the prosecution as part of the final disposition when defendants are found guilty ( or plead pre-trial ). So far your still in civil jurisdiction but who knows ?
I'm sure if I or others on this board hear of anything it will get posted. I did invest ( donate ) a smaller sum in the early transition days of RUNU so I could be a member of the " injured parties club " which to me at the time seemed inevitable. Thought it would be nice to have a " standing " when the s--t hit the fan. Now I like you and others have one should the matter fall into the right venue. PS - I did post my investment intentions on another popular stock board at the time and took some friendly flack because of it. Wasn't a problem 'till my wife found out. " YOU DID WHAT "... because of that should I ever get any restitution on this at any future time ?,,, she gets the check .
Either way don't hold your breath. No matter what's decided by whoever decides it it's going to be a long time coming if it goes your way.
