Yep, and if he leaves a class of shareholders out he also opens himself up to major lawsuits. He is on very shakey ground on this and Reg. FD rules. He better hope he fixes this and soon to everyones satisfaction or not only wil he have the SEC, but bagholders and loyal long will also turn on him if he screws them.
