Judge: You can see I purchased xxxxxxxx number of shares of BCIT through my brokerage firm xyz on August 16, 2005.
Trading on this stock stopped on August 30, 2005.
On September 15th 2007 I requested the shares I had purchased in certificate form as you can see by this letter.
On October 5th, 2007 my brokerage firm xyz wrote to me per this letter that they were unable to provide certs because the DTCC had put a Global Lock in place.
You can see by this next letter I tried once again on October 12, 2011 to obtain my certs from xyz but in their response date November 3rd, 2011 they were still blaming the Global Lock for not being able to produce my shares.
Now I ask you to read the DTCC notice that was issued to all brokerage firms claiming they would no longer provide services for BCIT dated August 11, 2005.
Your honor since my shares were purchased after the Global Lock was instituted by the DTCC there is no way the DTCC could be in custody of my certs.
Your honor, you should also read the Press Release issued by Mr Megas informing the brokerage firms that needed to purchase shares in certificate form, upon payment to the company they could be obtained on a first come first served basis while available.
Since my brokerage failed to buy my shares I am asking that I be awarded compensatory damages of $xxxxx consequential damages of $xxxxxx and punative damages if $xxxxxxx.
