The issue here is how large is the potential award and whether KK wants vindication/blood of the infringers or a reasonable settlement. If they are out of business no mater what option is in front of them with the exception of wining at some point in the legal process their direction is obvious.

Once it's a clear-cut and obvious case of infringment, (if there is serious or evident proof) then the best interest for all infringing companies involved in litigation currently would be to protect their companies and settle before further damages could be awarded to GERS beyond what is currently estimated or known of at the time. If things come out good for GERS then investors win.
