My understanding is that one of the factors that goes into treble damages is the credibility of the defense presented by the defendant, and excessive delays could go into that.
If they only infringed in the submission process, they seem safe (as they are going by the letter of the law). But if they infringe in the mfg process and present a slow smoke and mirrors trial I would assume treble damages is a real risk.
