Its the non-dttc effect. You can make the trade, you just have to call.

I do. You have to request an unlimited access via phone call. Otherwise you will be charged $7.95 for each of those 10k or 20k investments. 100k trade will only cost $7.95 instead of close up to $80.00 in fees

When you get the alert from Fidelity, it simply means that you need to contact them regarding the penny trading status. If you have not traded pennies before, you need to establish the relationship with Fidelity. Not a problem (especially if you are trading in your IRa), but you need to agree to the risk relationship.
