Mayhem, the permit has never been contingent on the dry stacking facility. The dry stacking was an acceptable (to DRMS) method of dealing with mine tailings rather than using the existing tailings ponds which caused the C&D order.

The holdup on the C&D was a reclamation plan for the existing tailings ponds for the mill. The reclamation is taking place now and once all of the conditions are met, the C&D will be lifted on the permit, and yes............the mill be go operational and yes.........CGFIA will get back a boatload of the bonds paid to ensure such reclamation.
