Dean wouldn't go to jail if there was an exposure anyway - but he might have the state regulators crawling up his butt if he didn't do everything in an approved manner.
Like I said before, it is totally possible to do the demo w/o causing exposure. What I'd be curious about is who determined there was no exposure and how.
Do they have calibration records?
Have they taken dose rates at various distances when the DViS was in use?
How far away were people standing from the DViS when it was in use?
Did anyone standing there have a meter to measure exposure during the demo?
I can't believe any of that is off the discussion table due to the NDA - it's all very basic, normal radiation safety everyday stuff. Personally, I'd second guess the sh!t out of anyone who tried to legally shut my yap in regard to a potential exposure. This is your health and you have every right to know exactly what you were exposed to(or not) and how it was determined.
Figured the tech would have a badge but unless the tech was using some form of SRPD (self reading pocket dosimeter) they won't have his dosimetry results back immediately - and they won't be able to tell how much dose (if any) he got at the demo and how much he got through normal work. The tech's badge provides NO information about anyone else's (potential) exposure during the OH. It simply will show the that employees exposure over a given time period (dosimeters are often used for a month or more before being read).
