They've threatened legal action in the past, and nothing ever came of it. Probably because a) they couldn't afford it, and b) they knew they didn't really have much of a case.
I seriously doubt that they'll pursue any legal action this time around either -- for much the same reasons (not to mention the fact that they're too busy defending themselves in court). However, we might see another "press release" that says they "intend" to go after some folks. The problem is, they've been so dishonest that they've lost any credibility they might have ever had.
