It's better than that. Would getting the final payout from Berlin be considered "progress"? Then reporting it as such when it happens would constitute a "progress report".

Yo Mr Ed, how about issuing a statement indicating you'll file a 10Q sometime in the next 3 months? Oops that would be "promissory".
