I think what happened was that both parties met before the Judge, had some conversations about what witnesses and evidence would be allowed and what would not. The Judge probably looked at both parties and said, "Are both of you ok with this", there was no complaints and whatever was agreed on was approved by the Judge.
Do I think that all of Drago's witnesses as per Markle's origional filling will be thrown out? Probably not. Do I think Markle will be allowed to testify about his own attorney fees - probably. But I cannot say for sure since I have the same information as you.
