1) The situation is being resolved. There are a number of legislative pieces fighting to set the sector free 2) A number of states and recently Washington DC have opened the door for medical marijuana 2.5) 3 states are moving forward to try for outright legalization in 2012

The fight is being fought and the momentum is shifting to the legalization side. The Fed isn't even fighting back that hard other than some pretty shitty raids and arrests. Otherwise the new Cole Memo didn't have much for teeth and there is a good chance Obama will need our vote in 2012.

I would not say the sector is stagnant. It's actually fairly active.

oakair, excellent points, the Fed isnt likely to get the legislation through to change the drug laws affecting ERBB and others in this sector any time soon, they are really the key since Federal law trumps state law, the thing on the Fed side though is that they really cant just legalize it without violating international treaty, so about the only way they will, is if, and thats a big if, they reschedule it to a pharmacuetical and place its regulation under the FDA, in which case, big pharma will likely move in with the Government blessing.
