I believe the grounds for a class action exist. This was more then just a forward looking PR. we have S.E.C filings. If we can drag Gate into it then it would settle rather quickly. They have the money and they cant afford the BAD PR.
Even as they resigned PRS were issued saying they were going forward with the deal.
I guess a Penny will be a Penny. PR's are not to be believed.
